Les présentes Conditions Générales de Location régissent les relations contractuelles entre :
JM Services, entreprise individuelle immatriculée au Registre du Commerce et des Sociétés de Pointe-à-Pitre sous le numéro 849 336 789, exploitée par Madame Jennifer MOYA, dont l'établissement principal est situé Route de Caraque, 97139 Les Abymes, Guadeloupe.
KaruCars est l'enseigne commerciale sous laquelle JM Services exerce son activité de location de véhicules.

Ci-après dénommée « le Loueur ».

Toute personne physique ou morale procédant à la réservation ou à la location d'un véhicule auprès du Loueur.
Ci-après dénommée « le Locataire ».
Toute réservation, signature d'un contrat de location ou prise en possession d'un véhicule implique l'acceptation pleine et entière des présentes Conditions Générales de Location.
Les contrats de location sont conclus entre le Locataire et JM Services, exploitant l'enseigne commerciale KaruCars.
Pour pouvoir louer un véhicule auprès de JM Services, le Locataire doit :
Le Loueur se réserve le droit de refuser une location si les conditions ci-dessus ne sont pas remplies.
Toute réservation est soumise à la disponibilité des véhicules.
La réservation devient définitive après :
Le solde de la location doit être réglé avant la remise du véhicule, sauf accord particulier du Loueur.
Les tarifs sont exprimés en euros et comprennent les prestations indiquées lors de la réservation.
Un dépôt de garantie de 900 € est exigé pour chaque location. Celui-ci est réalisé exclusivement par préautorisation bancaire sur une carte de paiement au nom du Locataire.
Le Locataire s'engage à vérifier avant la prise du véhicule que le plafond de sa carte bancaire permet la réalisation de cette préautorisation.
En cas d'impossibilité de réaliser la préautorisation bancaire, le Loueur pourra refuser la remise du véhicule sans indemnité ni remboursement des frais déjà engagés.
Le dépôt de garantie a pour objet de couvrir :
La caution est restituée après vérification du véhicule et sous réserve de l'absence de dommage ou de frais restant à la charge du Locataire.
Le véhicule est remis au Locataire en bon état de fonctionnement, propre intérieurement et extérieurement.
Un état des lieux contradictoire est établi lors de la remise et de la restitution du véhicule.
Le Locataire s'engage à restituer le véhicule :
Tout retard supérieur à une heure pourra entraîner la facturation d'une journée supplémentaire selon le tarif en vigueur.
Lorsque l'état du véhicule nécessite un nettoyage approfondi, une désinfection, un traitement des odeurs ou toute autre intervention exceptionnelle, JM Services se réserve le droit de facturer les frais suivants :

L'ensemble des véhicules exploités par JM Services est strictement non-fumeur.
Il est interdit de fumer, vapoter ou consommer toute substance produisant fumée, vapeur ou odeur persistante à l'intérieur du véhicule.
La présence d'odeurs de tabac, de cigarette électronique, de cigare ou de tout autre produit fumé entraînera automatiquement l'application d'un forfait de 150 € TTC.
Le Loueur propose une option nettoyage du véhicule au tarif forfaitaire de 40 € TTC.
Cette option doit être souscrite au plus tard 24 heures avant la restitution du véhicule.
Cette option ne couvre pas :
Le Locataire est seul responsable des infractions au Code de la route commises pendant la durée de la location.
En cas d'accident, de vol ou de panne, le Locataire doit immédiatement contacter JM Services au 06 90 16 33 15.
Tous les véhicules loués par JM Services sont couverts par une assurance automobile conforme à la réglementation en vigueur.
Le montant de la franchise applicable est indiqué dans le contrat de location remis au Locataire.
Conformément à l'article L.221-28 du Code de la consommation, le droit de rétractation de 14 jours ne s'applique pas aux prestations de location de véhicules.
Conformément aux articles L.611-1 et suivants du Code de la consommation, le Locataire peut recourir gratuitement à un médiateur de la consommation.
JM Services est actuellement en cours d'adhésion à un organisme de médiation de la consommation.
Les présentes Conditions Générales de Location sont soumises au droit français.
À défaut de règlement amiable ou de médiation aboutie, tout litige sera soumis aux juridictions compétentes conformément au droit français.
