The rental of the car described is made according to the following conditions accepted by the renter:
Article 1 - USE OF THE CAR - Under penalty of cancellation of the insurance policy renter agrees not to allow the car to be driven by otherperson than himself or those approved by MORISOLEIL LTD and whom he is answering for,to use the vehicle only for his requirements, to take part in no competition, not to use the vehicle for unlawful purposes or for the transportation of goods,not to push or tow any vehicle or trailer not to take passengers and not to overload the rentered vehicle by taking a number of passengers above the one stated on the car licence.
Article 2 - (1) USE OF THE CAR -The car is delivered in perfect working order and in absolutely clean condition.The odometers and their connection are sealed and the seals are not to be carried off or broken.otherwise the rental shall be paid on the standard rate of 200 km a day.The vehicle shall be returned in the same condition of neatness ,otherwise renter shall have to paid the cleaning and over-hauling cost.The five tyres are in fair condition without cut.In case of damage to one of them for a reason other than normal wear and tear,renter agrees to replace it at once by a tyre of same and or an obviously similar wear.
EQUIPMENT - Damage or loss of equipment the detail of which is show over leaf, is not covered by either insurance deposit or by the insurance waiver charge and is thereby the responsibility of the hirer.
Article 3 - GASOLINE AND OIL -Gasoline shall be chargeable to customer;renter has to regularly check the oil and water-levels.he shall warrant any additions by correspondence bills.
Article 4 - MAINTENANCE AND REPAIRS -Normal Mechanic,wear and tear is MORISOLEIL LTD responsibility.Any and all repairs arising from abnormal wear and tear due to want of care on the part of the renter shall be chargeable to him and carried out by us in the event of the immobilization of the vehicle.The repairs shall be carried out only after written approval and according to instruction of MORISOLEIL LTD.The repairs must be fully itemized in receipted bill, the replaced defective parts ought to be produed together with the receipted invoice.Under no circumstances,shall the renter be able to claim indemnity,either for delay in delivering the car,cancellation of the hiring or immobilization in the even of repairs carried out during the renting term.MORISOLEIL LTD shall never be held liable,even in case of accidents of persons or property arising out of defects or defaults in construction or in former repairs.
Article 5 -(1) INSURANCE - Only the drivers authorized by Morisoleil ltd are entitled to be insured.They are insured against the following risks:
a). For an unlimited amount against accidents causing bodily injury any or death to third parties,including those they carried free ofcharge,but exclusive of renter and driver and of ,when they are in the MORISOLEIL LTD car,the wife or the husband, the ascendants and offspring of the renter or of the authorized driver.
b). Against theft and burning of the rented vehicle.Unless it is due to obviuos want of care on the part of the renter.
c). For a limited,amount of Rs....................... against accidents causing material damage.
d).Against damage to the car ,however with an excess of Rs.......... remainig owed by the renter in the event of an accident.
Under penalty of cancellation of the insurance policy,renter agrees :
(i) To report within 24 hrs to MORISOLEIL LTD and at once to the police Authorities, any accident,theft of fire occurrred even partial;b)to mention in this report the circumstances,place of accident,name and address of the witnesses car's number of the opposing party a well as the name of his insurance company and number of his policy; c)To attach to the report any police statement or affidavit made by a prosecutor,if any ;d)to,refrain from admitting any responsibility,from dealing or compounding with third parties regarding the accident.
(ii)Clothes,if any and all items carried in the car are not covered.
(iii) The car is insured only for the length of the rental.At the end of this term and only if the prolongation has been accepted,MORISOLEIL LTD declines any liability for the accident renter might have occasioned which he personally shall have to deal with.
(iv)MORISOLEIL LTD,declines any liability for injuries to third parties or accidents to the car renter might cause during the length of rental agreement if renter intentionally provided MORISOLEIL LTD with false information in respect of his identuty, his address or the validity of his driving licence,and there is no valid insurance in this case.
(v)Lastly, there is no insurance at all for any driver who does not possess a valid driving licence.Moreover insurance for damage to the rented vehicle and personal accident is cancelled if driver is in drunken state.
Article 6 - HIRING,DEPOSIT,PROLONGATING - Payment can be made in Euro (€), Mauritian rupees or credit card (Visa or Master). For payment by card, a supplement of 5% is charged as bank fee in Mauritius. A deposit of 375€(Rs 15000) is taken and is returned at the end of the contract unless if there is any accident or damages caused to the vehicle. In case of prolongating, MORISOLEIL LTD should be informed 24hr before the end of the contract. For Delivery and Collection, an addition of 25€(Rs1000) is charged all around the island.
Article 7 - REPATRIATION OF THE CAR - REPATRIATION OF THE CAR - Renter expressly prohibits himself from abandoning the vehicle.in the event of material impossibility the car shall be repatriated by MORISOLEIL LTD at the renter's expenses,the rental being due until the return of the vehicle.
Article 8 - DOCUMENTS OF THE CAR - immediately on the termination of the hiring and the return of the car,renter shall deliver the licence and all the documents required for it running,failing which the rental charge shall continue to be invoiced until their delivery to MORISOLEIL LTD.
ARTICLE 9 - RESPONSIBILITY - Renter remains solely liable for any fines,report and official statements drawn up against him.
Article 10 - JURISDICTION - Any and all disputes which may arises between MORISOLEIL LTD and the renter shall fall under the exclusive jurisdiction of the court of Mauritius.
MORISOLEIL LTD reserves the right to claim back its vehicle incase the renter do not abide to our terms and conditions.
