La société Car’Ent (ci-après « Car’Ent », « le Loueur », « Nous ») met à disposition du Preneur un véhicule dans les conditions définies par le présent contrat.
La signature du contrat vaut acceptation pleine et entière des présentes Conditions Générales, établies afin d’assurer une location sécurisée, transparente et sereine.
Car’Ent demeure seul propriétaire du véhicule loué.
Toute cession, sous-location ou mise à disposition à un tiers non autorisé est strictement interdite.
Le véhicule ne peut être conduit que par le Preneur ou les conducteurs expressément déclarés au contrat.
Il est interdit de confier le véhicule à toute personne non titulaire d’un permis valide ou se trouvant sous l’emprise d’alcool, de stupéfiants ou en état de fatigue excessive.
Conditions générales :
Le Preneur s’engage à utiliser le véhicule avec soin, à respecter le Code de la route et à assurer sa sécurité.
Aucune réparation ne peut être effectuée sans l’accord écrit de Car’Ent.
Le véhicule est remis en bon état de fonctionnement avec l’ensemble des documents requis.
Un état des lieux est réalisé au départ et au retour.
Le véhicule doit être restitué :
La location est facturée par tranche de 24 heures.
En cas de restitution hors horaires, la responsabilité du véhicule reste à la charge du Preneur jusqu’à la réouverture de l’agence.
Une caution est exigée à la prise en charge du véhicule.
La franchise est strictement égale au montant de la caution.
Montants applicables :
Le Preneur est responsable du véhicule pendant toute la durée de la location.
En cas de dommage, vol ou accident, la responsabilité financière est limitée au montant de la franchise.
Les éléments non couverts par l’assurance restent à la charge du Preneur.
Sous réserve du respect du contrat, le Preneur bénéficie d’une assurance couvrant :
Toutes les sommes dues doivent être réglées intégralement.
Tout retard de paiement pourra entraîner des intérêts légaux.
Le carburant manquant sera facturé selon les tarifs affichés en agence.
Tout accident, vol ou acte de vandalisme doit être :
Le Preneur est seul responsable des infractions et amendes encourues.
Si celles-ci sont adressées à Car’Ent, elles pourront être refacturées avec les frais engagés.
Car’Ent se réserve le droit de résilier immédiatement le contrat en cas de non-respect des présentes Conditions Générales ou de comportement mettant en danger les personnes ou le véhicule.
Le présent contrat est soumis au droit français.
Tout litige relève de la compétence exclusive des juridictions françaises.
