Les présentes Conditions Générales régissent les relations contractuelles entre la société UCS (ci-après « le Loueur ») et le locataire, dans le cadre de la location de véhicules de tourisme à Saint-Martin.
Le locataire doit être âgé d’au moins 21 ans, titulaire d’un permis de conduire valide depuis plus d’un an, et présenter une pièce d’identité en cours de validité. Le Loueur se réserve le droit de refuser la location sans justification.
Le véhicule ne peut être conduit que par le locataire ou les conducteurs expressément agréés par le Loueur. Toute utilisation non conforme (usage illicite, compétition, surcharge, remorquage, transport rémunéré de personnes ou marchandises) entraîne la déchéance des garanties d’assurance.
Le véhicule est remis en parfait état de fonctionnement et de propreté. Le locataire s’engage à le restituer dans le même état. Tout dommage, choc, rayure, ou détérioration non signalée au départ sera facturé selon la grille forfaitaire annexée.
Le carburant est à la charge du locataire. Les niveaux (huile, liquides) doivent être surveillés. Toute négligence entraînant une usure anormale sera facturée au locataire.
Le véhicule est assuré pour les dommages causés aux tiers conformément à la législation en vigueur. Ne sont pas couverts : les effets personnels, les dommages causés par un conducteur non autorisé, sans permis valide, ou sous l’emprise d’alcool ou de stupéfiants. En cas d’alerte cyclonique, le véhicule doit être restitué immédiatement.
Une caution de 850 €, correspondant au montant de la franchise, est exigée par préautorisation bancaire. En cas de sinistre responsable, vol ou dégradation, tout ou partie de la caution pourra être conservée par le Loueur.
La location est consentie pour une durée déterminée. Toute prolongation doit être acceptée par écrit par le Loueur. À défaut, le locataire s’expose à des poursuites pour abus de confiance.
Le locataire demeure seul responsable des infractions au Code de la route, amendes et contraventions. Des frais de gestion pourront être appliqués pour le traitement administratif.
En cas de vol, la caution est intégralement conservée. En cas d’immobilisation due à une faute du locataire, aucun remboursement ne pourra être exigé.
Tout litige relatif au présent contrat relève de la compétence exclusive des tribunaux de Guadeloupe.
