Les présentes Conditions Générales de Location régissent toute location de véhicule conclue entre Smart Move Car Rental (« le Loueur ») et le Client (« le Locataire »). La signature du contrat de location implique l'acceptation sans réserve des présentes conditions.
Le Locataire doit être âgé d'au moins 21 ans, être titulaire d'un permis de conduire valide et présenter une pièce d'identité. Seuls les conducteurs inscrits au contrat sont autorisés à conduire le véhicule.
Un dépôt de garantie est exigé avant la remise du véhicule. Les montants applicables sont de :
Le dépôt de garantie peut être utilisé pour couvrir tout dommage, frais ou manquement aux obligations prévues dans le contrat de location.
Le véhicule doit être utilisé avec soin et conformément au Code de la route. Il est strictement interdit :
Le véhicule doit être restitué à la date et à l'heure convenues, avec le même niveau de carburant qu'au départ.
Un délai de grâce d'une heure est accordé. Au-delà de ce délai, une journée supplémentaire de location pourra être facturée.
Des frais de nettoyage pouvant aller jusqu'à 100 € pourront être appliqués si le véhicule est restitué dans un état nécessitant un nettoyage spécifique.
Tous les véhicules sont couverts par une assurance tous risques avec franchise obligatoire, conformément aux conditions de location en vigueur.
En cas d'accident, de dommages, de tentative de vol ou de vol du véhicule, le Locataire reste responsable à hauteur de la franchise applicable à la catégorie du véhicule loué, sauf dans les cas prévus par les garanties souscrites ou par la loi.
La garantie ne s'applique pas en cas de non-respect des présentes Conditions Générales de Location, notamment en cas de conduite sous l'emprise de l'alcool ou de stupéfiants, d'utilisation non autorisée du véhicule, de négligence grave, de fausse déclaration ou de tout autre cas d'exclusion prévu par le contrat d'assurance.
Tout accident, panne ou vol doit être signalé immédiatement au Loueur.
Aucune réparation ne peut être effectuée sans l'accord préalable du Loueur, sauf en cas d'urgence.
Un véhicule de remplacement pourra être proposé selon les disponibilités, lorsque la panne n'est pas imputable au Locataire.
Les véhicules peuvent être équipés d'un système GPS destiné à assurer la sécurité du véhicule et à faciliter sa récupération en cas de besoin.
Les données personnelles collectées sont traitées conformément à la réglementation applicable en matière de protection des données personnelles.
Le Locataire est responsable des amendes, frais administratifs et infractions commises pendant toute la durée de la location.
Toute clause déclarée invalide ou inapplicable n'affectera pas la validité des autres dispositions des présentes Conditions Générales de Location.
Tout litige relatif à la location relève des juridictions compétentes deSaint-Martin.
